Constitutional Breach: The retroactive application of the new rules infringes on fundamental principles such as legal certainty, non-retroactivity of laws, and the protection of legitimate expectations—cornerstones of the Portuguese Constitution.


Conflict with EU Law: The proposal may also run afoul of European Union principles, including the Charter of Fundamental Rights and rulings from the European Court of Justice, possibly prompting EU intervention.


Procedural Irregularity: Setting an effective date before the law has passed Parliament is not only irregular but also undermines democratic legitimacy and the authority of the legislative process.


Investor Fallout: The proposal has sent shockwaves through Portugal’s once-thriving Golden Visa and D7 Visa investment programs. Billions of euros in real estate, tech startups, and green initiatives are now clouded in uncertainty. Legal experts warn of compensation claims, frozen projects, and a sharp decline in investor interest.

As the debate intensifies, Global Citizen Solutions is calling on the Portuguese government to reconsider the current path and instead adopt a reform process that respects the country’s constitutional framework and international obligations.


“Portugal must remain a country where laws are predictable, commitments are honored, and constitutional rights are non-negotiable,” asserted Joana Mendonça, the firm’s General Counsel and a recognized authority on constitutional and EU law.


Mendonça emphasized that legal and immigration reform must be transparent, equitable, and inclusive—and above all, not weaponized to punish those who have already followed the rules in good faith. She urged Parliament to ensure any changes undergo full democratic scrutiny and include transitional provisions to safeguard current applicants and residents.


“Immigration should be a positive force for the country,” Mendonça added. “We are all called to be an active part of building a system that is coherent, inclusive, and serves the interests of all stakeholders.”
