Law Prohibiting ‘Distracted Driving’ to be Fully Enforced on Thursday

Fifteen days after the publication of its Implementing Rules and Regulations (IRR), the law prohibiting forms of distracted driving for both public and private vehicles shall take full effect on Thursday, May 18.

The Anti-Distracted Driving (ADD) Law under Republic Act 10913 describes “distracted driving” as the performance by motorists of any acts on the usage of their mobile communication devices, electronic entertainment and computing gadgets or devices while vehicles are in motion or temporarily stopped on a traffic light or an intersection. A motorist, as defined under this law, is a person who is driving a motor vehicle.

Such prohibited acts made while driving include but not limited to: making or receiving calls, writing, sending or reading text-based communications, playing games, watching movies, performing calculations, reading e-books, composing messages, and surfing or browsing the internet.

Motorists, however, are allowed to apply hands-free function or applications in the use of such devices or gadgets so long as these do not interfere with their line of sight.

This new law is a preventive measure to avoid or lessen accidents and injuries from happening while promoting road safety and responsible driving among our motorists.

Aside from public and private vehicles, this law also covers wheeled agricultural machineries, construction equipment, and other forms of conveyances such as bicycles, pedicabs, trolleys, “habal-habal”, “kuligligs”, wagons, carriages, and carts that may either be, human-powered or pulled by an animal, as long as the same are operated or driven in public thoroughfares, highways or streets.

This law takes exemption when motorists use their mobile phones in making or taking an emergency call from/to: a law enforcement agent/agency to report a crime or prohibited act, accident, natural calamity, bomb threat, terrorist activities and the like; a government or non-government medical or health care provider on emergency and rescue situations; or to a fire department in cases of fire or explosion.

Violators will be penalized with a fine of five thousand pesos (Php5,000) for the first offense, ten thousand pesos (Php10,000) for the second offense, and fifteen thousand pesos (Php15,000) for the third offense with a three-month suspension of driver’s license. Violations incurred beyond the third offense shall be penalized with the revocation of driver’s license and a fine of twenty thousand pesos (Php20,000).

Owners and operators of Public Utility Vehicles (PUV) and commercial vehicles found in violation of the said Act shall both be held liable.

The DOTr - Land Transportation Office (LTO) is the lead implementing agency of the Act. The LTO also has the authority to deputize members of the PNP, MMDA, and LGUs to carry out enforcement functions and duties.

"To Ambassador Amanda Gorely, thank you so much for inviting me today. I would like to express my gratitude to your country’s continuing support to our human rights work in the Philippines, particularly the welfare and security of our LGBT brothers and sisters.

This year’s International Day Against Homophobia and Transphobia (IDAHOT) is a reminder to re-commit ourselves to a future where everyone can live in peace and security no matter who we are and who we love.  In a time when gay people are detained and tortured in the Russian region of Chechnya, shot at for simply having fun in a club in Orlando, and killed because of their sexual orientation and gender identity, similar to what happened to Jennifer Laude in Olongapo City, we have to remain brave and determined as we continue to fight for human rights and equality. More than ever, we must uphold the principle of global solidarity to fight and eliminate discrimination borne out from an outdated view of human sexuality.

In 2011, when the United Nations High Commissioner was asked to report on discrimination and violence based on sexual orientation and gender identity to the Human Rights Council, the following observations were noted all over the world:

Ø  Different states had adopted or strengthened their antidiscrimination and hate crime laws. Some introduced legal protection for intersex persons. Others had abolished criminal sanctions for homosexuality, allowed marriage and civil unions for same-sex couples, instituted reforms granting legal recognition of transgender persons.
Ø  In other countries, programs had been established to ensure that the police, judges, prison guards, medical staff and teachers are receiving gender and sexuality training, that there are anti-bullying programs in schools, and that shelters are built to house homeless LGBT youths.

These were significant developments. These will certainly contribute and strengthen our David-like resistance against the Goliath-like forces of hate and violence which the LGBTIQ community continues to face. 

In the Philippines, just a few weeks after Jennifer Laude’s death, Mary Joy Anonuevo, a transgender woman, was stabbed 55 times in a club in Lucena City, Quezon. From 2008 to 2014, 29 cases of transgender killings were documented in the country, the highest in Southeast Asia and the second-highest in Asia. 

In another independent study, the UNDP reported that in the first half of 2011 alone, 28 LGBT-related killings had already been reported in the country. 

These numbers are extremely alarming. They represent a deadly and irrational prejudice against those who do not conform to the traditional notion of sexual identity and orientation and a deep-seated hate that we refuse to acknowledge and address. For a country seen by many as liberal and tolerant of different views, the Philippines still has a long way to go in protecting the rights and lives of the LGBT community.

The Duterte government’s attitude towards this problem is also troubling. While many governments chose to respond positively and pro-actively to this issue, the Philippine government has chosen to default. In the recent vote in the United Nations Human Rights Council (UNHRC) to retain the Independent Expert on Discrimination and Violence against LGBTIQs, the Philippines abstained. Citing our lack of policy against discrimination, the Duterte government has chosen to renege on our human rights obligations. We let hate win.

This problem has been compounded by the growing climate and culture of sexism and misogyny in the country.  Women’s dignity in government has been reduced to body parts, rape jokes have become tolerable, online sexual harassment is now a political strategy to shut off contrarian views and catcalling is reinforced as a perverse  ‘compliment’ to women and an exercise of the right to freedom of expression.

We cannot continue to live like this.

As a response, I filed the Anti-Discrimination bill to eliminate all forms of discrimination based on “sexual orientation and gender identity or expression (SOGIE). It lists and defines discriminatory acts which are to be proscribed and penalized. The bill mandates the creation of social protection and diversity programs that will protect LGBTIQs rights and promote equality. It will ensure that discrimination, stigma, and hate would not hinder anyone from access to education, healthcare, employment, and other fundamental rights.

My proposed measure will also compel the Philippine government to fully comply with its obligations under the Universal Declaration of Human Rights (UDHR), International Covenant on Civil and Political Rights (ICCPR), and the International Covenant on Economic Social and Cultural Rights (ICESCR). It will give life to and uphold the equal protection clause enshrined in our 1987 Constitution.

The bill was already sponsored at the Senate plenary and is currently in the middle of the period of interpellation.  After nearly 2 decades, our bill seeking to protect the lesbian, gay, bisexual, transgender, queer, and intersex (LGBTQI) community from hate crimes and discrimination has finally reached the Senate plenary, and is being debated vigorously. Imagine our senators discussing the concept of SOGIE, which a year ago was totally unknown to many of them.

However, the struggle is far from over. There are still many legislative hurdles that we need to surmount. Yet, with the unwavering support of advocates and different social movements working for equality, I am confident that we will be able to overcome the challenges and enact this landmark piece of legislation.

Aside from this, my office has started to talk to advocates and study possible policy interventions to effectively address hate speech based on SOGIE. The old idiom, “sticks and stones may break my bones but names will never hurt me” is not true. Hate speech loads guns. Discriminatory speech leads to discriminatory policies, which in turn becomes a license for prejudiced minds to assault and hurt those who they do not understand and/or those that they are taught to hate. The principle of nondiscrimination is one of the underlying thrusts of any democratic society. This kind of language has no place in our community. It is affording impunity for committing discrimination and tolerating human rights abuse.

My dear friends, our long fight against discrimination is fueled by our uncompromising belief that a world that is equal and kind is possible.  As we observe this year’s International Day Against Homophobia and Transphobia, let us remind ourselves not only of the reality and ugly consequences of hate and discrimination, but also of the inspiration behind our activism for equality.

The protection of the dignity of every human person must without reservation form part of our national policy. The Anti-Discrimination Bill is our commitment to the fundamental equality of all persons before the law, a fulfillment of our long and overdue promise—human rights for all.

The revolutionary and martyr Dr. Ernesto “Che” Guevarra once said that “the true revolutionary is guided by great feelings of love.” I believe this speaks well for our advocacy.

Friends and fellow advocates, our struggle for equality is revolutionary, it is guided and nurtured by love. And in the end, love will trump hate. Love will win. We will win.

Boracay-Based Swedish Martial Artist Feels Excited for ONE Championship Debut

Singapore is in for a treat as one of the best welterweights in the Asia Pacific region has directed his career path to ONE Championship, which is widely considered as the mixed martial arts (MMA) juggernaut of Asia.
Swedish standout Zebaztian “The Bandit” Kadestam will make his promotional debut under the ONE Championship banner on the undercard of ONE: DYNASTY OF HEROES, which takes place at the 12,000-seater Singapore Indoor Stadium in Kallang, Singapore on 26 May.
Kadestam is an MMA veteran, who holds an 8-3 professional record and has competed for some of the continent’s top promotions.
Six of his eight career victories have come by way of knockout, including a 11-second stoppage of Finnish rival Glenn Sparv in April 2016.
Training out of Legacy Gym in Boracay, Aklan under the tutelage of decorated kickboxer and MMA trouper Ole Laursen, Kadestam made his mark in the sport’s growing scene in Asia by capturing the welterweight championship of a regional organization before successfully defending it twice in dominating fashion.
Now finally finding his way to ONE Championship, Kadestam sets his sights on establishing a lasting impression as he shares the cage with former ONE Welterweight World Championship title contender Luis “Sapo” Santos at ONE: DYNASTY OF HEROES.
“I am grateful for the opportunity that has been given to me by this well-respected MMA promotion. ONE Championship is the premier MMA organization in Asia. With my debut taking place this coming May 26, it’s a chance to show the world what I am capable of doing inside the cage,” she said.

With a black belt in Brazilian Jiu-Jitsu and a penchant for spectacular finishes, Santos has emerged as one of ONE Championship’s most overwhelming physical specimens – a fighter capable of finishing a bout in a variety of ways at any given moment.
Known for his aggressiveness and brute strength, Santos looks to continue his dominance inside the ONE Championship cage in his next outing against Kadestam.
“We are keenly studying my opponent for this fight. He is a more experienced fighter than I am. I know what he is capable of doing inside the cage. But I view this as a challenge that can truly benefit my career. It’s an honor to share the cage with a great warrior like him,” Kadestam said of Santos.
Although many cageside observers speak highly of him due to his impressive track record, Kadestam is more than willing to meet their expectations as he vows to notch a decisive triumph in his favor.

Red Bull’s Signature 3x3 Tournament Kicks Off in Cebu: Which Team Will Reign Supreme?

31 teams went head-to-head this past Saturday, May 13th 2017, at the Red Bull Reign Cebu Qualifier with two teams prevailing, Team Chan and San Remegio Properties, who will now advance to the National Finals in Manila.

Red Bull Reign is the brand’s signature 3x3 basketball tournament that pits hopefuls against one another in a high-endurance, offensive-driven battle that will end with over 15 countries sending their best to compete at the World Finals in Washington DC, USA. The rules of this tournament are simple: the team that scores the most overall points in each round will advance until one team remains.

Team Chan rose above the competition with a total of 34 points. Team Captain Jason Chan dedicated his team’s performance and victory to his older brother, Joel Chan, who was severely injured early last week.

Jan Michael Auditor, Team Captain for San Remegio Properties, credited his team’s win to practice, hard work, and his team’s ability to overcome the abilities of their competition.

Collectively, both Team Chan and San Remegio Properties sent out a warning to their competition in the North. “Manila competitors, be prepared: we’re coming for you!”

DOE Rolls Out Hybrid "Energy Efficient "Cars

The days of fuel-guzzling government agency vehicles are numbered.

The Department of Energy (DOE) is introducing the replacement of service vehicles of the national government offices with hybrid cars as part of its campaign to promote energy efficiency and clean air across the country.

At 10:00 a.m. on Friday, May 19 at the DOE Sunken Garden, the DOE will donate 24 Japan-made Toyota Prius (2017 model) to the Office of the President, Department of the Interior and Local Government, Department of Finance, Department of Foreign Affairs, Department of Budget and Management, Department of Transportation (DOTr), Department of Tourism, Department of Trade and Industries (DTI), Department of Environment and Natural Resources (DENR), National Economic Development Authority, Department of Science and Technology (DOST), and the Philippine National Police.

Eight (8) hybrid cars will also be given to government offices in Region 8 including the Department of Environment and Natural Resources, Department of Trade and Industry, Department of Science and Technology, Bureau of Fire Protection, Philippine Information Agency, Department of Transportation-Land Transportation Office, and the Regional Disaster Risk Reduction and Management Council in support to the economic and social recovery of communities devastated by Super Typhoon Yolanda


“This Japan government-aided grant will jumpstart our drive towards our call to action to our fellow public servants to increase their use or patronize energy efficient technologies, including their official vehicles. We have to be the role model in this cause, so our people can look up to us and follow our lead,” said DOE Secretary Alfonso Cusi.

Officials of the DOE's Energy Utilization Management Bureau and Japan’s Ambassador to the Philippines, Kazuhide Ishikawa, will turn over the hybrid Toyotas to the said beneficiaries.

Japan's Non-Project Grant Aid (NPGA) funded the acquisition of the Toyota Prius, which emits lower carbon emission. The hybrid car has an optimized fuel engine and electric motor to attain highest energy efficiency.

Bacolod Gets Ready for Color Manila's CM Blacklight Run

After the recently concluded CM Challenge Cebu last May 14, that drew thousands in attendance; Bacolod folks who can’t wait for their turn to have that Color Manila experience, can now look forward to the next CM Blacklight Bacolod run, set to take place on the evening of June 3, 2017.

The run will be held at The District North Point, Bacolod, and is part of the 3-city CM Blacklight Tour that includes Manila and Davao City.

For a quick preview of what to expect, participants will be immersed in glow-in-the-dark vibrant colored powder in a series of color stations. They will also be wearing the CM Blacklight headlamps to heighten their blacklight experience. For Rockstar and Challenge categories, they will also have face paint applied on their faces.

Of course, runners can look forward to the signature Color Festival at the end of their journey, wherein everyone throws colored powder up in the air (and at their friends), while the latest beats are playing and everyone just dances to the music.

Participants can choose between three race distances - the 3K, 5K and 10K categories, and 3 types of kits - the Deluxe, Rockstar and Superstar kits. Fortinet Urges Organisations in APAC to Take Preventive Measures as Devastation of Massive Ransomware Attack Widens

As Ransomware WannaCry and its variants continue their global ‘cyber-siege’ across multiple industries, Fortinet, a global leader in high-performance cyber security solutions strongly advises organizations in APAC region to take immediate steps to protect against the highly virulent ransomware strain.

“Fortinet’s FortiGuard Labs has been monitoring and analyzing threat telemetry gathered from over two million sensors around the world. WannaCry and its variants is a highly virulent ransomware strain which is capable of self-replicating. This ransomware is being referred to by a number of names, including WCry, WannaCry,WanaCrypt0r, WannaCrypt and Wana Decrypt0r. It spreads through an alleged NSA exploit called ETERNALBLUE that was leaked online in April 2017 by a hacker group known as The Shadow Brokers. ETERNALBLUE exploits vulnerability in the Microsoft Server Message Block 1.0 (SMBv1) protocol,” said David Maciejak, Director of Security Research at Fortinet.

"WannaCry has infiltrated thousands of organisations around the world, including many key institutions. This ransomware is especially notable for its multi-language ransom demands that support more than two-dozen languages,” added Maciejak. Fortinet’s tracking analysis shows that there has been an average of more than 4,000 ransomware attacks every day since January 1, 2016.

If an organization has been affected by ransomware, Fortinet strongly advise the following steps to be taken:

  1. Isolate infected devices immediately by removing them from the network as soon as possible to prevent ransomware from spreading to the network or shared drives. 
  1. If your network has been infected, immediately disconnect all connected devices.
  1. Power-off affected devices that have not been completely corrupted. This may provide time to clean and recover data, contain damage, and prevent conditions from worsening.
  1. Backed up data should be stored offline. When an infection is detected, take backup systems offline as well and scan backups to ensure they are free of malware.
  1. Contact law enforcement immediately to report any ransomware events and request assistance
For organizations that have so far been spared a ransomware attack, Fortinet recommends that users and organizations take the following preventive measures:
  • Establish a regular routine for patching operating systems, software, and firmware on all devices. For larger organizations with lots of deployed devices, consider adopting a centralized patch management system
  • Deploy IPS, AV, and Web Filtering technologies, and keep them updated
     
  • Back up data regularly. Verify the integrity of those backups, encrypt them, and test the restoration process to ensure it is working properly
  • Scan all incoming and outgoing emails to detect threats and filter executable files from reaching end users
  • Schedule anti-virus and anti-malware programs to automatically conduct regular scans.
  • Disable macro scripts in files transmitted via email. Consider using a tool such as Office Viewer to open attached Microsoft Office files rather than the Office suite of applications
  • Establish a business continuity and incident response strategy and conduct regular vulnerability assessments
“Fortinet addresses organizations’ cyber security challenges with an intelligent Security Fabric that spans the entire network, linking different security sensors and tools together to collect, coordinate, and respond to malicious behavior whenever it occurs,” said Maciejak. “Only by harnessing all their cyber defence resources in a coordinated way can firms effectively fight massive cyberattacks like WannaCry.”

Smart Supports Disaster Resilience Forum for Business

PLDT wireless subsidiary Smart Communications recently supported the 2nd Business and the Big One forum, which was organized by the Corporate Network for Disaster Response (CNDR) and American Chamber (AmCham) Foundation Philippines.

Following the recent spate of earthquakes in the country, the forum aimed to address calls by the government to prepare for the possibility of a magnitude 7.2 earthquake coming from the West Valley Fault and/or the Manila Trench. It also identified structural risk reduction and continuity measures for businesses, as well as the four quadrants or areas that may be subdivided by the Big One, and the likely damage in each location.

In his opening remarks, AmCham Foundation vice president Chris Nelson urged the forum participants, composed of corporate executives and management teams, to be prepared for disasters, saying no reliable technology to predict earthquakes had been invented yet.

For his part, Renato Solidum, Department of Science and Technology (DOST) undersecretary, said, “Extreme preparedness is needed for extreme hazards.” He also encouraged the participants to have a “disaster imagination” by imagining scenarios and creating solutions.

Ramon R. Isberto, PLDT/Smart public affairs head and CNDR president, moderated the open forum, which was joined by Solidum, Association of Structural Engineers of the Philippines former president Adam Abinales, and Metropolitan Manila Development Authority (MMDA) Crisis Monitoring and Management Center head Ramon Santiago.

“As a telecommunications provider, Smart needs to keep the service running, especially in times of disasters. We have provided continuous services and offered free calls and charging, and even satellite solutions, to areas affected by typhoons, earthquakes and other calamities,” said Isberto.

The forum also emphasized the need for families of employees to have their own preparedness plans. “This is a practical step to alleviate the situation. It may help us simplify things to make room for bigger things,” Isberto added.

Smart has been at the forefront of emergency preparedness and response in the Philippines, employing technology and communications as aid.
